Box 68 Loretta Pineda <br />Empire, CO 80438 Director <br />Re: Henderson Mine, Permit No. M- 1977 -342, Technical Revision No. 10 (TR -10) Conditional <br />Approval and As -Built Drawing and Post Construction Certifications Approval <br />Mr. Romig, <br />On January 15, 2014 the Division of Reclamation, Mining and Safety (Division /DRMS) conditionally <br />approved the Technical Revision application submitted to the Division on May 30, 2001, <br />addressing the following: <br />Installation of a groundwater interception wellfield below 1 -Dam tailings impoundment <br />The conditions of the Division approval are noted below. Please note that all other provisions of <br />Permit No. M- 1977 -342 remain in full force and effect. <br />Stipulation No. 1: <br />Climax Molybdenum Company is required to explain and provide a plan to demonstrate the <br />effectiveness and performance of the groundwater interception wellfield system as recommended <br />by Ajax and Clear Creek Associates in their assessment report dated January 3, 2013. <br />The Division accepted the engineering certifications and as -built drawings submitted on January <br />15, 2013 from URS Corporation, AJAX Mountain Enterprises LLC and Clear Creek Associates, PLC <br />for the project as required by Rule 7.3.2(2). <br />If you have any questions, please contact me at (303) 866 -3567 Ext. 8124. <br />Sincerely, <br />Peter S.
