Oxbow Mining, LLC Colorado Department of Public Health and Environment <br />Permit No. 98GUO812 - Air Pollution Control Division <br />Initial Approval — Modification 6 <br />visible emissions shall not exceed 30% opacity for more than six minutes in any sixty consecutive <br />minutes. Opacity shall be determined using EPA Method 9. (Reference: Regulation No. 1, <br />Section ILA. 1. & 4.) <br />10. All conveyors, screens, crusher, transfer and loading systems are subject to New Source <br />Performance Standards requirements of Regulation No. 6, Part A, Subpart Y, Standards of <br />Performance for Coal Preparation Plants as follows: <br />a. Visible emissions from screens, crusher, hopper loading, and conveyors /transfer <br />points shall be less than 20% opacity. <br />In addition, the following requirements of Regulation No. 6, Part A, Subpart A, General <br />Provisions, apply. <br />At all times, including periods of start-up, shutdown, and malfunction, the facility <br />and control equipment shall, to the extent practicable, be maintained and <br />operated in a manner consistent with good air pollution control practices for <br />minimizing emissions. Determination of whether or not acceptable operating and <br />maintenance procedures are being used will be based on information available to <br />the Division, which may include, but is not limited to, monitoring results, opacity <br />observations, review of operating and maintenance procedures, and inspection <br />of the source. (Reference: Regulation 6, Part A. General Provisions from <br />40CFR60.11) <br />C. No article, machine, equipment or process shall be used to conceal an emission <br />which would otherwise constitute a violation of an applicable standard. Such <br />concealment includes, but is not limited to, the use of gaseous diluents to <br />achieve compliance with an opacity standard or with a standard which is based <br />on the concentration of a pollutant in the gases discharged to the atmosphere. <br />(§ 60.12) <br />d. Written notification of construction and initial startup dates shall be submitted to <br />the Division as required under § 60.7. <br />e. Records of startups, shutdowns, and malfunctions shall be maintained, as <br />required under § 60.7. <br />f. Performance tests shall be conducted as required under § 60.8 <br />11. The process equipment are subject to the process weight rate of Regulation Number 6, Part B, III. <br />C. as follows: <br />For those pieces of equipment with process weight rate of 30 tons per hour or less, pounds per <br />hour emissions of total particulates shall not exceed 3.59'P° 62, where P = hourly process weight <br />rate (tons per hour). <br />For those pieces of equipment with process weight rate of more than 30 tons per hour, pounds <br />per hour emissions of total particulates shall not exceed 17.31 "P016, where P = hourly process <br />weight rate (tons per hour). <br />OPERATING & MAINTENANCE REQUIREMENTS <br />12. The applicant shall follow the most current operating and maintenance plan and record keeping <br />format approved by the Division in order to demonstrate compliance on an ongoing basis with the <br />051/0007/999 Page 5 <br />
