<br />Section 12: Lots 2 to 4, inclusive, SW ANWI /4, and those portions of SWAN P/4 and
<br />SE' /4NW' /4 lying north of the North Fork of the Gunnison River; containing a total of
<br />approximately 1,467.35 acres.
<br />The surface estate of the tract consists of approximately 1,427 acres of public land and 40
<br />acres of private surface.
<br />As previously noted in Section 2.03.4(9), Oxbow Carbon & Minerals, Inc. filed an application
<br />on October 2, 1997 for assignment of Federal Coal Lease COC -53510 to Oxbow Mining,
<br />Inc. as its successor in interest. The lease assignment was issued by the Bureau of Land
<br />Management effective January 1, 1998. A lease modification application was filed with the
<br />Bureau of Land Management on October 29, 1999, and was issued on January 1, 2000. The
<br />above - designed lands include the lease modification.
<br />Initial Federal Coal Lease COC- 61357, awarded to Oxbow Mining, LLC. by competitive lease
<br />sale on May 31, 2000 for the Elk Creek Tract, dated effective March 1, 2001.

<br />Oxbow Mining, LLC. applied for and obtained Federal Coal Lease COC- 61357, effective
<br />March 1, 2001. The base lease is 4,443.57 acres. A lease modification, Tract 2. of 159.99
<br />acres was added on February 13, 2003. A second lease modification, Tract 3, of 190.67
<br />acres was approved by the BLM on December 1, 2006. A third lease modification, Tract
<br />4, of 148 acres was approved effective January 1, 2009. A fourth lease modification, Tract
<br />5 (ECMS), of 156.77 acres was applied for on June 1, 2010 and approved on May 4,
<br />2012. Federal Coal Lease COC -70615 of 725.9 acres was applied for in September 2006
<br />and the lease was issued effective July 1, 2012.
