Section 2.03.12 2.03.6 Right of Entry and Operation Information (1) Detailed legal description of the permit boundary, description of the documents upon which the transferee bases its legal right to enter and begin coal mining operations and whether that right is the subject of pending litigation: Permit Boundary - Legal Description The surface facilities for the Elk Creek Mine, Sanborn Creek Mine, and the former Somerset Mine are located north of the town of Somerset, which is nine miles northeast of Paonia, Colorado. All are north of the North Fork of the Gunnison River (located due south of the town of Somerset) and north of State Highway 133 and the Union Pacific Railroad rights -of- way. The Elk Creek Mine is located approximately one mile north and the Sanborn Creek Mine is located approximately one mile east of the town of Somerset.
