<br />Somerset Mining Company applied for and obtained Federal Coal Lease COC 53510,
<br />effective November 1, 1992.
<br />The Lease was transferred to Pacific Basin Resources, a Division of Oxbow Carbon &
<br />Minerals, Inc. effective September 28, 1995.
<br />On April 1, 1996, Oxbow Carbon & Minerals, Inc. filed an application for modification
<br />of Federal Coal Lease COC- 53510. The lease modification sought to add an additional
<br />157.55 acres on the north and east boundaries of the current lease area. Oxbow Carbon
<br />& Minerals, Inc. withdrew this application January 8, 1997. Oxbow Carbon & Minerals,
<br />Inc. also filed an application for right -of -way June 5, 1996 and withdrew that application
<br />October 28, 1996.
<br />On October 2, 1997, Oxbow Carbon & Minerals, Inc. filed an application for assignment
<br />of Federal Coal Lease COC -53510 to Oxbow Mining, Inc. as its successor in interest.
<br />Oxbow Mining, Inc. filed a lease modification application on October 29, 1999 to add
<br />approximately 127.79 acres to Federal Coal Lease COC- 53510. This lease modification
<br />was approved and made effective on January 1, 2000.
<br />Oxbow Mining, LLC. applied for and obtained Federal Coal Lease COC- 61357, effective
<br />March 1, 2001. The base lease is 4,443.57 acres. A lease modification, Tract 2, of 159.99
<br />acres was added on February 13, 2003. A second lease modification, Tract 3, of 190.67
<br />acres was approved by the BLM on December 1, 2006. A third lease modification, Tract
<br />4, of 148 acres was approved effective January 1, 2009. A fourth lease modification, Tract
<br />5 (ECM5), of 156.77 acres was applied for on June 1, 2010 and approved on May 5,
<br />2012. Federal Coal Lease COC -70615 of 725.9 acres was applied for in September 2006
<br />and the lease was issued effective July 1, 2012.
