and drainage control in accordance with the approved reclamation plan and Rule 3. 031. 1(2)(a). <br />V. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve the request for a partial Phase I bond <br />release for the Trapper Mine. This proposed decision will release the applicant from reclamation liability <br />for Phase I bond release criteria for the SL -15 bond release parcels; A -13-13, Z -A -13 and K -A -13, <br />totaling 120.4 acres. <br />The reclamation cost estimate was last evaluated and updated in 2012 during the last Permit Renewal <br />(RN6). Based on the bond estimate conducted for RN6, the required liability for the Trapper Mine was <br />estimated to be $29,990,889.69. The Division currently holds a performance bond of $30,173,724.00. <br />The Division issued a proposed decision to the SL -14 bond release application on December 5, 2013 to <br />reduce the reclamation liability required for the site to $27,922,492.00. At the writing of this document, <br />the decision for the SL -14 bond release has not become final. <br />The Division proposes to release reclamation liability in the amount of $520,670.46 for the 120.4 acre <br />SL -15 bond release block. This amount is not greater than 60% of the applicable bond for these bond <br />release parcels in accordance with Rule 3.03.1(2)(a). Trapper Mining, Inc. did not request a reduction in <br />bond amount with the SL -15 bond release application. However, should Trapper Mining, Inc. reduce its <br />liability by $520,670.46, the remaining liability amount of $27,401,821.54(remaining liability assuming <br />the SL -14 bond release decision becomes final less the SL -15 liability reduction amount) should be <br />sufficient to complete the remaining reclamation work at the site if the work had to be performed by the <br />Division, including the cost of reestablishing vegetation on any revegetated areas, should those areas fail. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision may <br />request a formal public hearing before the Mined Land Reclamation Board in accordance with Rule <br />3.03.2(6). Public notice of this proposed decision will be published in the Craig Daily Press once a <br />week for two consecutive weeks as soon as possible. Requests for public hearing must be submitted to <br />the Division in writing within 30 days of the first publication.
