OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Hydrologic Balance <br />PROBLEM /POSSIBLE VIOLATION: Problem: The spillway required under the Durham Pit Flood Control <br />Mitigation Plan (FCMP) was destroyed during the recent flood event in the region. The FCMP was required by a <br />Board Order dated October 27, 2004 from the Mined Land Reclamation Board (Board) and was incorporated in <br />the Conditional Letter of Map Revision (CLOMR) approved by Weld County and FEMA. <br />CORRECTIVE ACTIONS: The Operator must reconstruct the spillway to the approved construction drawings and <br />submit an engineering certification and as -built drawings, if required, for the rebuilt spillway. <br />CORRECTIVE ACTION DUE DATE: 4 <br />OBSERVATIONS <br />The Durham Sand & Gravel Pit was inspected by Peter Hays with the Division of Reclamation, Mining and <br />Safety (Division /DRMS) as part of the Division's monitoring inspection program. The site was previously <br />inspected by the Division on April 15, 2011. Mr. Brad Janes with Varra Companies, Inc. ( Varra) was present <br />during the inspection. <br />The mine identification sign was posted at the entrance of the site and the mine boundaries were well defined <br />as required by Rule 3.1.12. <br />Page I of 5 <br />
