Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Colorado Division of Reclamation, Mining and Safety ( CDRMS) received Seneca Coal Company's <br />third quarter 2013 stockpond inspection reports on October 1, 2013. The Division finds the above <br />reference report to be in compliance with the following CDRMS regulation. <br />4.05.9(17) — Examined at least quarterly by a qualified person designated by the operator, for <br />appearance of structural weakness and other hazardous conditions. <br />4.05.9(17) — A copy of the report shall be submitted to the Division on a quarterly basis. <br />Several maintenance items were conducted in several of the stockponds; the dam on T -1 was removed in <br />the spring of 2012, the inlet channel to T -5 was rebuilt in 2012, the inlet channel to T -20 was repaired in <br />2013, T -25 was rebuilt in 2012 as a runoff control structure, the spillway for T -26 was lowered and the <br />spillway and outlet channel for T -27 was rebuilt. Based on the report, is appears that all the <br />impoundments inspected were functioning as designed at the time of the inspection. Please note that the <br />report for T -18 is out of agreement: Item number 10 states that the freeboard is 4.0 feet. Yet the <br />additional comments for item number 10 states that the water level is 3 feet below discharge. These <br />items should be in agreement.
