Hickenlooper <br />Governor <br />Mike King <br />Executive Director <br />Loretta Pineda <br />Director <br />The Colorado Division of Reclamation, Mining and Safety ( CDRMS) received Seneca Coal Company's <br />3rd Quarter 2013 Sediment Pond Inspection Report on October 1, 2013. The submittal includes <br />inspection reports for sediment ponds 005, 006, 009, 015, 016, and 017. All six ponds were inspected <br />on September 5, 2013. The Division finds the above reference report to be in compliance with the <br />following CDRMS regulation. <br />4.05.9(17) — Examined at least quarterly by a qualified person designated by the operator, for <br />appearance of structural weakness and other hazardous conditions. <br />4.05.9(17) — A copy of the report shall be submitted to the Division on a quarterly basis. <br />No maintenance items were conducted nor were concerns identified, and all sediment ponds were <br />functioning as designed at the time of the inspection. Sediment pond 005, 006 and 017 were observed to <br />have damp areas below the toe of the embankment. The reports did not indicate that this observation <br />posed a concern. Ponds 015 and 016 have previously experienced surrounding land instability <br />previously.
