October 23,2013 C-1981-041/Roadside Portals MPB <br /> areas or poorly vegetated areas were noted during the inspection. These include 2.6 acres at reclaimed Pond 7,2 <br /> West Portals(north),the berms along Diversion D-D10,berms along the permanent drainage channel at the North <br /> Decline, and approximately 0.5 acres along the southeast edge of the North Portal area adjacent to the Highline <br /> Canal. <br /> SUBSIDENCE—Rule 4.20: <br /> On October 7,2013 Mr.Fontanari filed a formal written objection to the pending bond release application SL-8. <br /> Prior to the submittal of his objection letter Mr. Fontanari voiced his concerns about several areas located both <br /> within and outside of his property boundary.The DRMS arranged an on-site meeting with Mr.Fontanari to <br /> specifically inspect each area of the site where he had concerns.This was conducted on September 18th and an <br /> inspection report was issued on September 25,2013. Please refer to the DRMS Inspection Report dated September <br /> 25,2013 for a detailed description of each location that Mr.Fontanari has raised concerns about which are also the <br /> focus of his October 7,2013 objection letter. The site was inspected again on November 19,2013 with Dan <br /> Hernandez and Rob Zuber of the DRMS to review Mr. Fontanari's concerns (refer to DRMS Inspection Report <br /> dated November 21,2013) available on our website. The primary purpose of this inspection was to view those <br /> areas identified in Mr. Fontanari's October 7, 2013 objection letter with other members of the DRMS. During this <br /> inspection we revisited the North Decline area,the two gravel pits associated with the Western Slope Flagstone <br /> Quarry No. 2,DRMS Permit No.M-1996-076,which Mr.Fontanari owns and operates,the Carey Pond and <br /> associated irrigation field, and the lower and upper irrigation ditch and pipeline,respectively.Mr.Fontanari <br /> diverts water from Rapid Creek to his active gravel pit via the upper irrigation ditch pipeline and in the past has <br /> also diverted water from Rapid Creek via the lower irrigation ditch to the Carey Pond. <br /> Mr.Fontanari attended the first day(October 23,2013)of this SL-8 bond release inspection to again voice his <br /> objections regarding the bond release. Mr.Fontanari raised two new concerns located within his property <br /> boundary during the inspection as follows. 1)He lead the inspection group out to the edge of a rock outcrop <br /> located on his property that overlooks Interstate 70 (see Photograph No. 19). This was the approximate location of <br /> a recent rock fall event that temporarily impacted I-70. He stated that he believes the rock fall occurred as a result <br /> of subsidence from the underground mining operation. 2)Later that afternoon Mr.Fontanari took us to another <br /> location en route to the 2 West Portals area. At this location he stated that there are subsidence cracks up on the <br /> hillside to the east of the location of the old "Go Boy Mine". The location was a substantial climb up the west <br /> facing slope of the mountainside (see Photograph No. 20). Several of the participants inspected the location and <br /> climbed up to the reported subsidence cracks. The cracks that were inspected due appear to be subsidence related. <br /> The lower of the two cracks that were inspected is shown in Photograph No. 21 and the upper area where cracks <br /> are present is shown in Photograph No. 22. <br /> Mr.Brant Harrison a landowner and owner/operator of Kokopelli Farm and Produce which is located within the <br /> current permit boundary attended the majority of the bond release site inspection. At the conclusion of the <br /> inspection on the afternoon of October 25th he inquired about the procedures for filing an objection to the bond <br /> release or filing a citizen complaint. He indicated that he believes there has been a change to the quantity of water <br /> in Rapid Creek which flows across the permit area and which he has water rights and diverts water from the creek. <br /> He stated that there has been a recent change in the amount of available water and he wondered if it could be due <br /> Number of Partial Inspection this Fiscal Year: 3 <br /> Number of Complete Inspections this Fiscal Year: 2 <br /> Page 8 of 18 <br />
