PERMIT #: M- 1977 -522 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: December 19, 2013 <br />INSPECTION TOPIC: Reclamation Success <br />PROBLEM/POSSIBLE VIOLATION: Problem: Current reclamation plan needs to be updated and clarified <br />pursuant to C.R.S. 34- 32.5 -116 (1). The operator must follow approved reclamation plan or provide sufficient <br />information to describe or identify how the operator intends to conduct reclamation. <br />CORRECTIVE ACTIONS: The operator shall submit a Permit Amendment, with the required $2,229 <br />amendment fee, to update and clarify the current approved reclamation plan to reflect existing and proposed <br />activities by the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 3/20/14 <br />OBSERVATIONS <br />This inspection of the Star Water Resource site was conducted by Eric Scott of DRMS accompanied by Lynn <br />Mayer Shults of LG Everist (LGE). This site lies between the Cache LaPoudre River and "O" Street on the <br />north side of the town of Greeley in Weld County, and is bordered on the east by a residential area. The permit <br />was recently taken over by LGE from the previous operator (Star Ready Mix) in a Succession of Operator <br />approved by DRMS on November 25, 2013. LGE does not plan to conduct additional mining at the site, but <br />does intend to reclaim the permit area as a developed water resource (lined water storage). <br />According to the last annual report submitted to DRMS by the previous operator in March 2013, no mining has <br />taken place at this site since September of 2006. The concrete plant that operates within the current permit area <br />is also now owned and operated by Varra Construction. Unfortunately, several potentially serious compliance <br />issues were noted during this inspection, including but not limited to, the issues listed on the first page of this <br />report. LGE is aware of these issues and is currently in the process of addressing several of them. LGE is also <br />aware that a permit amendment will be required to fully address several of these issues. DRMS appreciates the <br />fact that LGE has taken over this site and will be moving toward compliance, and therefore does not wish to be <br />over - aggressive with respect to the enforcement of pre- existing conditions at the site. However, DRMS would <br />like to see these issues addressed in a timely fashion. To that end, DRMS has set a corrective action date at 90 <br />days from the date of the inspection (March 20, 2014) for the submittal of a permit amendment which will <br />address all the outstanding issues and allow LGE to complete the successful reclamation of the site. <br />Inspection Contact Address <br />Lynn Mayer Shults <br />L.G.
