The <br />Applicant's accounting includes the 2% relinquishment requirement for the nontributary <br />Laramie -Fox Hills water. <br />The applicant has entered into a long term lease agreement with the City of Aurora <br />( "Aurora ") whereby Aurora will deliver up to 49 acre -feet of fully consumable water to the South <br />Platte River at the confluence of the South Platte River & Sand Creek, just north of Metro <br />Wastewater Treatment Plant. The confluence is located approximately 20 miles upstream of <br />the Baseline Resource site. A 0.25 percent per mile transit loss for November through March <br />(5.0 percent overall loss) and a 0.5 percent per mile transit loss for April through October (10.0 <br />percent overall loss) has been accounted for in the replacement schedule. The transit loss is <br />subject to change depending upon current conditions. <br />In addition to replacing depletions resulting from this mining operation, the City of Aurora <br />effluent will also be used by the Applicant to replace 21.65 acre -feet of depletions resulting from <br />operation of the Bestway Concrete Well No. 1 (aka the Litvak Well, permit no. 67418 -F, WDID <br />0210164), in accordance with the Bestway Concrete Augmentation plan (water court case no. <br />2004CW224). Since the City of Aurora effluent is being used as a replacement source for this <br />SWSP and the Litvak Well (case no. 2004CW224), the applicant's accounting for this SWSP <br />and case no. 2004CW224 must specify the total amount of effluent released and the amount <br />associated with this SWSP and the court case. <br />A monthly breakdown of depletions and replacements, including the Litvak obligations, is <br />shown on the attached Table 3. <br />Conditions of Approval <br />I approve the proposed substitute water supply plan in accordance with Section 37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />This SWSP shall be valid for the period of January 1, 2014 through December 31, 2014, <br />unless otherwise revoked, modified, or superceded by decree. If this plan will not be <br />made absolute by a water court action by the plan's expiration date, a renewal request <br />must be submitted to this office with the statutory fee (currently $257) by November 1, <br />2014. <br />2. Well permit no. 67585 -F was obtained for the current use and exposed pond surface area <br />of the Parker - Dersham Pit, and well permit no. 66959 -F was obtained for the current use <br />and exposed pond surface area of the Baseline Pit in accordance with §37 -90- 137(2) and <br />(11), C.R.S. The Applicant is required to maintain a valid well permit for the current uses <br />at each site. <br />3. Well permit no. 75087 -F was obtained for dust suppression and concrete batching <br />purposes approved under this SWSP and must remain valid for the duration of this <br />SWSP. <br />4. The total surface area of the groundwater exposed at this site must not exceed 2 acres at <br />the Baseline Pit and 7.9 acres at the Parker - Dersham Pit during the approval period of this <br />SWSP resulting in an annual evaporative loss of 29.15 acre -feet. <br />5. The annual amount of water used at the operation shall not exceed 3.24 acre -feet for dust <br />control and 16.40 acre -feet for concrete production. Mining activities outside of an <br />
