Modification No. 4 to Federal Coal Lease COC -61209 provides right of entry to mine <br />coal from the following lands in Delta County, Colorado: <br />Township 13 South, Range 91 West. a P.M. <br />Section 5: SWNW, NWSW, SWSW, NESW, S /2NESENW, S /2SENW, <br />S /2NWSENW, SWSWNE, S /2NWSWNE, W /2NWSE; <br />Section 6: SENE <br />Containing approximately 265.00 acres. <br />The Union Pacific Railroad gave Bowie Resources LLC its consent to construct and <br />operate a unit train loadout on Union Pacific right -of -way. A letter documenting the <br />agreement from the Union Pacific Railroad is presented in Volume III, Tab 1. <br />Additionally, Wayside Farm & Cattle Company, Inc. (Rose Marie Williams a.k.a. <br />Rose Marie Fraizer) and Robert Bames have granted the Operator the right to enter <br />upon their property, permitted or otherwise, for the purposes of the construction, <br />operation and maintenance of the unit train loadout. The letters documenting the <br />agreements are presented in Volume ill, Tab 1. The Wayside Farm and Cattle <br />Company is now owned by Norton Seybert Colorado Holdings, LLC. <br />Through a Surface Access Agreement dated November 15, 2011, Turkey Track, <br />LLC granted the Operator permission to enter upon their lands and perform activities <br />necessary to support the Operators coal mining operation.
