Please submit an application for a revision to <br />incorporate this letter into Appendix 5 -1 of the permit, and revise the text of Page 5 -3 <br />of the ADP to address retention of the light use road <br />3. DRMS 04/19: (This issue was also addressed in the Division's 29- Aug -2012 letter to <br />Oakridge.) Removal and reclamation of the sediment ponds and ditches was <br />accomplished by OEI in 2009. During the July 2012 inspection, we observed that <br />portions of the East Collection Ditch and the East Collection Channel — Lower had not <br />been reclaimed during the 2009 effort. Oakridge felt that because these segments lay <br />within the bounds of the Ewing Mesa No. I Pit, they were the responsibility of that <br />permit to reclaim. We have reviewed the construction materials permit, and find that it <br />specifically states that the ditch remains part of the coal permit. Unless Oakridge can <br />document otherwise, we believe the reclamation of the East Collection Channel and East <br />Collection Ditch were and continue to be part of the Coal Permit. Please revise the <br />reclamation section of the abridged permit document to address these two features. <br />DRMS 12/18: In the 28 -Aug -2013 cover letter, it is stated that your research does not <br />lead you to the same conclusion regarding the disposition and responsibility for <br />reclamation of the east collection ditch/channel, and requested request was made that the <br />Division provide a reference to the cited sections of the Ewing Mesa No. 1 permit. For <br />specific information regarding the ravel permit, please contact Russ Means at the <br />DBMS office located at 101 South 3` , Suite 301, Grand Junction, CO 81501. For the location of the East <br />Collection Channel — Lower, please refer to the following permit maps: Surface Water <br />Control, dated Feb -1998, and Map 5 -913 East Collection Channel — Lower Section. <br />4. DRMS 12/18: A new map showing the Post - Mining Topography for the permit area was <br />incorporated into the permit with TR -17 in Oct -2013 (Map CLO in Appendix 5 -12). <br />Please revise the second paragraph of ADP subsection 2.05.4(2) to direct the reader to the <br />location of this map, and submit an application for a revision to the permit to remove the <br />other two maps that reflected PMT: the TR -11 and TR -13 Post - Mining Topography <br />Maps. (In order to streamline the TR -17 process, new Appendix 5 -12 was created for <br />insertion, but no other changes were made to the approved permit.) <br />5. DRMS 12/18: The APD addresses Reconstruction of Carbon Junction Canyon beginning <br />on Page 5 -10 of the Aug -2013 version. Please expand this section to reflect the work that <br />was accomplished in the Upper Carbon Junction area in Nov -2013, as approved under <br />TR -17, and direct the reader to Appendix 5 -12 for details. <br />2.05.5 — Post Mining Land Uses <br />I. DBMS 04/19: An alternate post - mining land use of industrial/commercial and <br />residential was approved for the Carbon Junction Mine in 1996 under TR -05. In July <br />2012, during a site visit attended by representatives of Oakridge and this agency, the <br />Division suggested Oakridge might consider changing the land use to rangeland or <br />wildlife habitat. This would require the establishment of a reclamation success standard, <br />
