The <br />Division approved 412.35 acres for Phase I bond release. Specifically excluded were: <br />SL -3 Exclusion Areas <br />Description <br />Acreage <br />Postmining Channel PM -2D <br />.85 acres <br />Postmining Channel PM -4D <br />.80 acres <br />Total <br />1.65 acres <br />SL -2 Exclusion Areas <br />Areas excluded from the SL -2 application that were not requested in the SL -3 application included <br />the "A" Pit Highwall Slump (AKA Pit Ramp Slide Area) and the Oil Well Road (10.37 acres). <br />Areas not requested for Phase I bond release in either the SL -2 or SL -3 applications, and therefore <br />not released at that time included, include the Tie - Across Haul Road (removed from the permit area <br />during PR6), the Mine Entrance Haul Road, the running surface of Road "J" in the South Extension <br />Area, culverts associated with the unreleased haul roads, the powerline light use road (LU -1B), the <br />sediment ponds, and the stock tanks. <br />SL -4 Phase I Bond Release Application <br />The SL -4 application was received by the Division on November 15, 2012 and deemed complete on <br />March 7, 2013. Seneca Coal Company published notice of the bond release application in the <br />Steamboat Pilot once weekly for four consecutive weeks, beginning on January 27, 2013 and <br />ending on February 17, 2013. SCC notified land owners within and adjacent to the mine permit <br />area, the Office of Surface Mining (OSM), the Bureau of Land Management (BLM) and other <br />interested parties of the application for bond release, as required by Rule 3.03.2(1). No comments <br />were received. <br />Due to wintery weather conditions, the bond release inspection was not conducted within the thirty <br />Page 7 of 18 <br />
