A <br />Montrose, CO 81401 -3146 <br />CONCERNING THE APPLICATION FOR Case Number: 06CW 123 <br />WATER RIGHTS OF GUNNISON VALLEY <br />PROPERTIES, LLC <br />Div: Ctrm: <br />in Gunnison County Colorado. <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND RULING OF THE REFEREE <br />This matter comes before the Referee upon the Second Amended Application of <br />Gunnison Valley Properties, LLC, 864 West South Boulder Rd., Louisville, CO 80027, by its <br />attorneys, Wilderson Lock & Hill, LLC, 525 North Main, Gunnison, CO 81230 for conditional <br />underground rights, conditional storage rights, conditional surface rights, change of water rights, <br />and approval of a plan for augmentation. The undersigned Referee, having reviewed the <br />Application and the record herein, and having become fully advised with respect to the subject <br />matter of the Application, hereby enters and makes the following Findings of Fact, Conclusions <br />of Law and Ruling in this matter: <br />FINDINGS OF FACT <br />Procedural History <br />1. The Original Application was filed on June 30, 2006 and the Amended <br />Application was filed December 29, 2006. The Second Amended Application was filed on <br />September 30, 2009. <br />2. The Original Application, Amended Application and Second Amended <br />Application were duly published in the resume. <br />3. The City of Gunnison fled a timely statement of opposition to the Amended <br />Application and the Board of County Commissioners of Gunnison County, Tomichi Creek <br />Wetlands, LLC and Mr. Joe Schultheis filed timely statements of opposition to the Second <br />Amended Application. <br />
