The inspection was conducted in response to the flooding of the St. Wain <br />Creek which occurred in September 2013. As noted in the Inspection Report dated November 29, <br />2013, Boulder County is the current owner of the property where the Lyons Quarry is located. <br />Following the inspection, Boulder County contacted the Division of Reclamation, Mining and <br />Safety (Division) and expressed concern over refuse which had been deposited during the flood <br />and which is currently located in close proximity to the St. Vrain Creek. Boulder County is <br />concerned that refuse may be transported from the site if the St. Wain Creek were to flood in the <br />spring when runoff from snow melt is at its peak. The Division agrees that there is the possibility <br />that refuse could be mobilized from the site. <br />The Division requests that Aggregate Industries remove any refuse that is in close proximity to <br />the St. Wain Creek, so that it does not leave the permitted mine site in the event of flooding in <br />the spring. Please respond to this request by January 15, 2014 and provide a plan for how and <br />when the refuse will be removed from the site.
