At a regular meeting of the Board of County Commissioners of Lincoln County, <br />Colorado held in Hugo, Colorado on April 29, 2011 there were present: <br />Steve Burgess, Chairman <br />Gary A. Beedy, Vice Chairman <br />Ted Lyons, Commissioner <br />Stan Kimble, County Attorney <br />Corinne Lengel, Clerk of the Board <br />Roxie Devers, County Administrator <br />Present <br />Present <br />Present <br />Absent & Excused <br />Present <br />Absent & Excused <br />when the following proceedings, among others, were had and done, to -wit: <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS, LINCOLN <br />COUNTY, COLORADO, AMENDING THE LINCOLN COUNTY ZONING <br />RESOLUTION TO DEFINE "MINING" AND TO MAKE MINING AN <br />ALLOWABLE USE IN THE AGRICULTURE ZONE. <br />RESOLUTION # It was moved by Commissioner and seconded by Commissioner to <br />adopt the following resolution: <br />WHEREAS, the Board of County Commissioners of Lincoln County, hereinafter <br />referred to as the `Board" did approve the Lincoln County Zoning Resolution on April 18, 2002, <br />which Zoning Resolution has since been subject to amendment; and <br />WHEREAS, C.R.S. 30 -28 -116 allows for Counties to amend zoning resolutions under a <br />prescribed method and procedure; and <br />WHEREAS, after revie of the purposes set forth in Section 1 -120 of the Zoning <br />Resolution, the Board of County1Commissioners has determined that it is in the best interests of <br />the citizens of Lincoln County, Colorado, to amend the Zoning Resolution as to allow the mining <br />of construction materials in the agriculture zone in Lincoln County in mines that have -been <br />properly permitted. <br />NOW, THEREFORE BE IT RESOLVED that the Zoning Resolution, upon approval <br />as required by statute, shall be amended as follows: <br />SECTION 1. ADDITION TO DEFINITIONS. Upon adoption of this Resolution, <br />Section 1 -160 "Definitions" shall be amended to include the following definitions of <br />"Construction Material," "Mining," and "Properly Permitted ": <br />Construction Material. Means rock, clay, silt, sand, and gravel extracted for use in the <br />production of non - metallic construction products. <br />Mining. Means the extraction of construction materials. The term includes transportation <br />or processing on affected lands. The term does not include the exploration or extraction of <br />petroleum, the extraction of coal, or the extraction of geothermal resources. <br />
