The Division received comments from the Colorado Division of Water Resources, History <br />Colorado, the Army Corps of Engineers and Mr. Paul Lightsey. The letters are attached for <br />review. Please address the comments noted in the letters and make any changes to the <br />application as necessary. <br />6.4 SPECIFIC EXHIBIT REQUIREMENTS — REGULAR 112 OPERATIONS <br />The following items must be addressed by the Applicant in order to satisfy the requirements of <br />C.R.S. 34- 32.5 -101 et sec. and the Mineral Rules and Regulations of the Mined Land <br />Reclamation Board <br />6.4.3 Exhibit C - Pre - Mining and Mining Plan Maps of Affected Land <br />4. The red text in the Exhibit C -1(A), C -1(B) and C -2 maps are difficult to read. Please revise <br />the maps to provide for more legible text on the maps. <br />6.4.4 Exhibit D - Mining Plan <br />5. Please confirm the Applicant intends to operate the site continuously or if the Division should <br />consider the site an "intermittent operation" as defined in C.R.S 34- 32.5- 103(11)(b). <br />6. The Applicant states materials may be conveyed to the adjacent Durham Project for <br />processing and sale. Please include construction and design details for the conveyor <br />structure or commit to submitting a technical revision to the permit in the future to include <br />the conveyor structure in the permit. <br />The Applicant states the method of mining is "presently" dry. Please confirm mining activities <br />have not started at the site and describe all water diversions and impoundments required for <br />the proposed dry mining method. <br />6.4.5 Exhibit E - Reclamation Plan <br />8. Please provide a signed copy the backfill notice by Mr. Christopher Varra. <br />9. Please state if the Applicant intends to use fertilization as part of the Reclamation Plan. If <br />so, please specify types, mixtures, quantities and time of application. <br />10. As required by Rule 6.4.5(1), please state the depth of overburden to be salvaged, where <br />the material will be stockpiled, and the depth to which overburden will replaced during <br />reclamation. <br />
