Pineda <br />Director <br />RE: Reason to Believe a Violation Exists at Bates - Hunter Mine; DRMS File No. M- 1990 -041 <br />Dear Mr. Otten, <br />On August 22, 2013, the Division of Reclamation, Mining and Safety (Division) conducted an inspection <br />of the Bates - Hunter Mine and cited the following problem: <br />1. Numerous unlabeled 55 gallon drums of milling reagents were observed on the outside of the mill <br />building; one of the drums was corroded and the contents of the barrel had spilled onto the <br />ground. <br />On September 19, 2013 the Division mailed notice to you requiring a financial warranty increase in the <br />amount $10,500.00 to be submitted within 60 days of the date of notice. To date, the required additional <br />financial warranty has not been submitted to the Division. In addition, the Division has received no <br />documentation that the corrective action has been completed. <br />Therefore, the Division believes that this is a violation of: <br />1. C.R.S. 34 -32 -124 for failure to comply with the conditions of an order, permit or regulation. <br />2. C.R.S. 34- 32- 117(4)(c)(II) and Rule 4.2.1(2) for failure to post additional financial warranty <br />within 60 days of the date of notice of adjustment. <br />Therefore, we have reason to believe that violations exist to DRMS File Number M- 1990 -041 and to the <br />Law, and have scheduled this matter to appear before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the January 15"' and 16"', 2014 Board Meeting for <br />consideration of a possible violation. The hearing will be held in Room 318 of 1313 Sherman Street, <br />Denver, Colorado, beginning at 9:00 a.m. on January 15"' or as soon thereafter as the matter can be <br />considered. At that hearing you will have the opportunity to be represented and heard. It will be <br />reiterated that there is reason to believe that you are in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist Order and/or assess a Civil <br />Penalty in the amount of $50.00 to $200.00 for each day of violation.
