Compliance With Mine Plan N - Support Facilities Not On-site <br /> N -Other N - Special Categories Of Mining <br /> N -Processing Waste R -Topsoil <br /> COMMENTS <br /> This was a partial inspection of the Terror Creek Loadout conducted by Jim Stark of the Colorado Division of <br /> Reclamation, Mining and Safety. There were no representatives of Terror Creek,LLC present on the inspection. <br /> The loadout is currently only operational on an as-needed basis and was not operational at the time of the <br /> inspection. The weather was cool and clear and the ground was basically dry. <br /> HYDROLOGIC BALANCE -Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br /> 4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br /> Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage—Acid and Toxic Materials 4.05.8; <br /> Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br /> -The sediment pond contained a small pool of water approximately three feet below the bottom of the discharge <br /> pipe and was not discharging at the time of the inspection. The pond embankment was well vegetated and stable <br /> and no erosional problems were noted. The emergency spillway was clear and stable. <br /> -The dug-out pond was dry at the time of the inspection. The pond was well vegetated and stable and no <br /> erosional problems were noted. <br /> -The roadside ditches were all dry at the time of the inspection. The ditches were clean,with very little sediment <br /> observed. The ditches were well vegetated and stable and there were no erosional problems noted in either the <br /> ditch inslopes or the ditch bottoms. <br /> GENERAL MINE PLAN COMPLIANCE: <br /> -The Terror Creek Loadout is a loadout only. Operations at the site include processing coal (sizing coal) and <br /> loading trains. The site was not operating at the time of the inspection and will only be operational when an order <br /> for coal is received. The lump and stoker coal piles were basically gone but there was a large coal fines pile at the <br /> time of the inspection.
