Summary and Conclusions <br />Based upon a review of the mine permit, TMI's bond release application, engineer certifications for the <br />Horse Gulch fill and site inspections, the Division finds that Trapper Mining, Inc. has completed regrading <br />and drainage control in accordance with the approved reclamation plan and Rule 3.03.1(2)(a). <br />V. PROPOSED DECISION <br />Based on the observations above, the Division proposes to approve the request for a partial Phase I bond <br />release for the Trapper Mine. This proposed decision will release the applicant from reclamation liability <br />for Phase I bond release criteria for the SL14 bond release parcels; A -B -12, F -A -12, F -A -11, F -A -10, F- <br />AB-09, A -B -09, A -B -10, Z -A -10, K -A -11 and K -A -10, totaling 417.8 acres. <br />The reclamation cost estimate was last evaluated and updated in 2012 during the last Permit Renewal <br />(RN6). Based on the bond estimate conducted for RN6, the required liability for the Trapper Mine was <br />estimated to be $29,990,889.69. The Division currently holds a performance bond of $30,173,724.00. <br />The Division proposes to release reclamation liability in the amount of $2,068,397.69 for the 417.8 acre <br />SL 14 bond release block. Trapper Mining, Inc. did not request a reduction in bond amount with the SL 14 <br />bond release application. However, should Trapper Mining, Inc. reduce its liability by $2,068,397.69, the <br />remaining liability amount of $27,922,492.00 should be sufficient to complete the remaining reclamation <br />work at the site if the work had to be performed by the Division, including the cost of reestablishing <br />vegetation on any revegetated areas, should those areas fail. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision may <br />request a formal public hearing before the Mined Land Reclamation Board in accordance with Rule <br />3.03.2(6). Public notice of this proposed decision will be published in the Craig Daily Press once a <br />week for two consecutive weeks as soon as possible. Requests for public hearing must be submitted to <br />the Division in writing within 30 days of the first publication.
