of Incompleteness
Dear Ms. Wiebers,
On December 2, 2013 the Division of Reclamation, Mining and Safety (Division) received your
response to the Division's Incompleteness Notice sent to you on November 13, 2013 in regard to
the Amendment Application for the Owl Canyon Quarry. The Division has identified several
items which must be received before the Division can consider your application as being
submitted and technical review can begin:
6.4.17 Exhibit Q — Proof of Mailing of Notices to Board of County Commissioners and Soil
Conservation District
The Applicant provided copies of return receipts for certified mailing to the Board of County
Commissioners and the Soil Conservation District. The return receipts were date stamped in
1985 and appears to be the original receipts for a previously submitted Amendment
Application. The Applicant must submit new notifications to both the Board of County
Commissioners and the Soil Conservation District. Proof of such notifications may be in the
form of a return receipt of a certified mailing or a date - stamped copy of the notice
acknowledging receipt by the appropriate local board.
6.4.18 Exhibit R — Proof of Filing with County Clerk and Recorder
2. The Applicant provided a copy of the public notice required by Rule 1.6.2(1)(d) for Exhibit
R. The newspaper notice was published in 1985 and does not satisfy the requirements of
Exhibit R. The Applicant shall provide an affidavit or receipt indicating the date on which the
application was placed with the local County Clerk and Recorder for public review, pursuant
to Rule 1.6.2(1)(c).
