Pineda <br />FROM: Tom Kaldenbach TW 1!/``"f /{ <br />Director <br />East Minerals Team Supervisor <br />RE: Application package and special instructions for obtaining an expedited review <br />of a I I I(c) permit application, as authorized in Executive Order 2013 -027 <br />DRMS is authorized to conduct expedited reviews of 111(c) permit applications pursuant to Executive Order 2013 -027 (a <br />copy is in the attached pdf file). The expedited reviews will be limited to 111(c) permit applications for sites that support <br />flood - repair projects in the following flood - impacted counties: Boulder, Adams, Larimer, Weld, Arapahoe, Broomfield, <br />Clear Creek, Denver, El Paso, Fremont, Jefferson, Logan, Morgan, Pueblo and Washington. <br />The expedited reviews will be available for applications submitted no later than December 31, 2013. The normal <br />application fee of $898 must accompany an application. An approval resulting from an expedited review will be subject <br />to a condition that a full 111(c) or other permit application be submitted within 90 days of the approval. <br />To receive an expedited review of a 111(c) permit application, an operator must submit to DRMS one completed copy of <br />items 1 through 4, below. Blank forms are in the attached pdf file, or you can access forms on the DRMS website <br />at http: // mining. state. co. us/ SiteCollectionDocuments /Constructionl I lApp.pdf. <br />1. Construction Materials 111(c) Permit Application form, including Exhibits A, G, K, and L —The following <br />items do not need to be submitted for the expedited review and approval, but must be submitted within 90 days of <br />approval of the expedited I I I (c) permit: <br />• Proof of posting of a notice at the site <br />• Proof of notifications to the local board of county commissioners <br />• Proof of notifications to the local conservation district <br />• Proof that a copy of the application was placed with the county clerk and recorder <br />• Exhibits B, C, D, E, F, H, I, and J <br />Structure Agreement form — This form must be submitted, as nonnally required, if structures exist within 200 feet <br />of the affected land. <br />Performance Warranty form — This form must be submitted, as normally required. <br />4. Financial Warranty form — This form and financial warranty of $2,500 per affected acre must be submitted. <br />Forms for the three most common types of financial warranty (cash, corporate surety, bank letter of credit) are in the <br />attached pdf, along with an affidavit of authority to execute financial warranty documents, which must accompany <br />whichever type of financial warranty is submitted.
