In settlement of any and all claims or causes of action that the United States has or <br />may have against Currier related to or arising ut of the over <br />g Covered Conduct, within seven days of <br />the effective dateiof this Settlement Agreement, Currier shall pay the United States the sum of <br />I <br />two hundred and fifty -five thousand dollars ($255,000.00) ( "the Settlement Amount ") by <br />electronic funds transfer, pursuant to written instruction to be provided by the United States <br />Attorney's Office) for the District of Colorado. <br />C9<-^ Upon the full payment described in Paragraph 8, the United States autho- r z Ms? <br />i <br />Curlier to remove all. existing,_extracted "and`crushed gravel that is— rently located_on_Lot >2. <br />Ms. Currier will provide the BLM Grand Junction Field Office Manager with 5 days notice prior <br />I <br />to any removal of, any gravel from Lot 2 so that BLM may observe. Ms. Currier will provide the <br />i <br />BLM Grand Junction Field Office Manager with written notice within 7 days after all gravel has <br />been removed from Lot 2. Ms. Currier shall take reasonable measures to control nogious weeds <br />1 <br />and control erosion on the gravel pit area of Lot 2 until the land sale described in Paragraph 10 is <br />completed. <br />1 <br />10. Within six months of the execution of this Settlement Agreement, the BLM will <br />initiate the process of offering of a direct land sale of Lot 2 (Township 9 South, Range 93 West, <br />Section 12) consisting of 23.64 acres to Currier, pursuant to 43 C.F.R. Subpart 2711. Currier <br />I <br />agrees to pay all administrative costs not to exceed $15,000.00 for processing the sale of Lot 2 to <br />a <br />i <br />BLM, which may include, but is not limited to, appraisals, publications, NEPA compliance, <br />mineral report, cultural clearances, endangered species clearances, and hazardous materials <br />�Y�ihalt- 's 1) 1 <br />
