The <br />following information is provided in response the letter: <br />As noted in the annual reports for the past several ears, there has been a dispute with the <br />p Y p <br />BLM over the correct legal description for the lands surrounding the pit. A settlement <br />agreement was signed with the BLM effective September 26, 2013. A survey map is <br />enclosed which depicts the agreed upon land boundaries (Exhibit A). As you can see the pit <br />is now located on four different quarter - quarter sections. Three of those are private <br />ground and one is:the piece claimed by BLM. <br />In the settlement agreement the BLM gave us permission to access the lands to remove <br />stockpiled gravel. ' Please see the attached paragraph 9 of the settlement agreement <br />(Exhibit B). Additionally the BLM has agreed to sell the affected lands to us. When this is <br />accomplished the pit would once again be on all private ground and we will complete <br />reclamation. <br />Reclamation cannot be completed until the stockpiled gravel can be sold and removed. <br />Annual reports for the past several years document the decline of oil and gas activities in <br />our area which were the primary customers for the gravel. Currently there is little to no <br />demand for the gravel. No assurance can be provided that demand will increase and the <br />gravel will be removed prior to summer 2014. As you explained, stockpiled gravel and <br />moving stockpiled gravel is considered mining activity With this in mind, at your <br />recommendation, we will notify the Division prior to summer 2014 the status of activity in <br />the pit to determine whether to file to Temporary Cessation status. <br />
