FINDINGS OF THE STATE ENGINEER <br />IN THE MATTER OF AN APPLICATION FOR A PERMIT TO CONSTRUCT A CLAY MINE WELL <br />IN WATER DIVISION NO. 1, JEFFERSON COUNTY, COLORADO <br />APPLICANT: GENERAL SHALE BRICK, INC. <br />AQUIFER: LARAMIE -FOX HILLS <br />PERMIT NO.: 74957 -F <br />In compliance with C.R.S. 37 -90- 137(1) and the Statewide Nontributary Ground Water <br />Rules, General Shale Brick, Inc., (hereinafter "applicant ") submitted an application for a permit <br />to construct a clay mine well and appropriate ground water from the Laramie -Fox Hills aquifer. <br />Based on information provided by the applicant and records of the Division of Water Resources, <br />the State Engineer finds as follows: <br />1. The application was received complete by the State Engineer on December 29, 2010. <br />2. The applicant proposes to construct the clay mine well in the SE1 /4 of the NW1 /4 of Section <br />25, Township 4 South, Range 70 West, 6th Principal Meridian. <br />3. The proposed well is located outside the boundaries of a designated ground water basin. <br />4. The applicant proposes to apply the water withdrawn from the clay mine well to the following <br />beneficial uses: dust control, evaporation and dewatering to facilitate mining. The quantity <br />of water required for these requested uses is 0.9 acre -feet per year for dust control, 1.69 <br />acre -feet for evaporation based on an exposed water surface of 0.71 acres and a net <br />evaporation of 2.37 feet per year and 8.8 acre -feet feet for dewatering to facilitate mining. <br />See attached Figure 2 and Tables 1 and 2. <br />5. The requested average annual amount of ground water to be withdrawn is the amount <br />determined to be available. <br />6. The applicant is the owner of the land on which the clay mine well will be located. <br />7. At a proposed depth of 200 feet the clay mine well would withdraw ground water from the <br />Laramie -Fox Hills Aquifer (hereinafter "aquifer"). <br />8. The location of the proposed clay mine well is more than 600 feet from any existing well . <br />completed in the aquifer. <br />9. According to a sworn statement, the applicant owns, or has consent to withdraw ground <br />water underlying 57.8 acres of land as further described in said statement, which is attached <br />hereto as Exhibit A. Upon review of the application it was determined that only 40.6 acres of <br />the subject property is underlain by the Laramie -Fox Hills aquifer. <br />
