0011 <br />General Shale <br />Building The American Dream <br />November 22, 2013 <br />Colorado Department of Natural Resources <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Attention: Mr. Peter Hays <br />Subject: Chieftain South Mine, Permit No. M- 1981 -148 <br />Dear Mr. Hays: <br />General Shale Brick, Inc. is in receipt of your inspection report dated October 17, 2013 <br />The report cited the following problem: <br />"The Division has no evidence the Operator has a valid substitute water supply plan or <br />approved water augmentation plan for the exposed groundwater at the site. This a <br />problem related to 34- 32.5- 116(4)(h) of the Colorado Revised Statues and 3.1.6(1)(a) of <br />the Construction Materials Rules and Regulation governing injuring to existing water <br />rights. <br />Corrective Action: <br />General Shale has a water well permit and decreed water rights from the State Engineer's <br />Office (SEO) for the groundwater exposed at the Chieftain South Mine. A copy of these <br />documents is enclosed.
