As you may know, the Foidel Creek Mine, <br />Permit No. C- 1982 -056 issued pursuant by the Division's Regulatory Program, shall carry with it the right of <br />successive renewal upon expiration of the term of the permit, in accordance with the provisions of Rule 2.08.5 of <br />the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. Per Rule 2.08.3, the Division <br />shall review each permit issued every 5 years. The permit term for all permits issued by the Division is for a <br />period of 5 years. Permit Renewal No. 6 for which you have received notification as a surface owner, is TC's sixth <br />permit renewal since the issue of the permit in 1982. <br />Let's see if I can address some of your questions <br />With regard to the Divisions Notice of Proposed Decision as required by Rule 2.07.3(5), the Division is required to <br />publish once a week for two consecutive weeks in a newspaper of locality. The first public notice was published <br />in the Steamboat Pilot & Today on October 13, 2013 and the second notice was published on October 20, 2013. <br />The Public Review of the application can be conducted at the Routt County Courthouse, which I believe is a paper <br />copy of the RN -6 application, and the Division's offices. I am under the impression that the letter you received <br />only identifies two address', the Divisions address and the recipient of the letters address. In reference to the <br />statement "at the address above" the letter identifies the Division's address of 1313 Sherman St.; Room 215 <br />Denver, Colorado 80203. Unfortunately, the Division's hours are not listed on the address; however normal <br />operating hours for the Division's offices is 0800 to 1700 with no closures for lunch. A copy of the application can <br />be accessed at the Division's office for no fee. In addition, all information pertaining to RN -6 can be accessed <br />and printed from the Division's Imaging System on -line at the following web address: <br />http: / /mining.state.co.us /Reports /MiningData /Pages /imagedDocumentData.aspx <br />The site includes a Document Management Users Guide to help negotiate the Image System. The system is the <br />same as can be found at the Division's offices. <br />All surface ownership and mineral ownership information has been updated to reflect current conditions. In <br />addition, the mining limits and mine permit limits have been reviewed and updated as required to provide an <br />accurate depiction of on -the ground and permitted conditions.
