We have provided a license agreement for the Operator's signature, which will <br />address our concerns regarding the proposed mining activity within our easement. We have also <br />advised the Operator that we intend to sign the proposed Structure Agreement at the time we sign <br />the license agreement. <br />We are hereby respectfully notifying the State that the proposed mining activity may have a <br />significant impact on Western's facilities and it is essential that the Operator enter into the <br />Structure Agreement and the proposed license agreement with Western before any work is <br />commenced within our easement so we may be assured that the mining activity will not <br />adversely affect our facilities and operations. <br />If you have any questions or need any further information, please feel welcome to contact Brian <br />Pederson at 970 - 461 -7220 or by email at bpederson @wapa.com. <br />Sincerely, <br />Carey Ashton <br />Realty Officer <br />
