Volume 111A, Tab 14
United States Forest Paonia
0 USDA Department of Service Ranger District
Agriculture PHONE VINO. 970-527-4131
P.O. Box 1030
N Rio Grande Ave.
Paonia, CO 81428
FAX 970-527-4151
File Code: 2820-4
Date: December 4, 2007
Collin Stewart
Bowie Resources, LLC
PO Box 1488
Paonia, CO 81428
Dear Collin,
This letter is in regards to your inquiry on pricing and disposition for the mineral materials
generated by the Hubbard Creek Shaft project.
It is our current understanding that Bowie has generated approximately 3000 cubic yards of
excess mineral material, primarily rip-rap, from the preparation of the Hubbard Creek Shaft drill
pad. In your correspondence dated Nov. 26, 2007, you also stated that excess top soil (estimated
at 500 yd3) is expected to be temporarily stored off site.
The USFS is required to dispose of mineral Taterials under 36 CFR 228, Subpart C. Under
Section 228.62, the USFS can issue a "Free-use" permit to local governments, providing mineral
materials at no charge, with a few prohibitions. In this particular case the USFS has no problem
issuing the Town Of Paonia a free-use permitt for the excess mineral materials generated at the
shaft site. Once the amount of material provided to the Town is finalized, please contact this
office and we will follow up with the appropriate paperwork. If material is removed from the
Forest and not sent to the Town, then the USFS must charge Bowie for that disposition.
With respect to the off-site temporary storages, the USFS grants permission to allow Bowie to
temporarily store the topsoil off-site, for up to 5 years, provided the following:
• If the exact material can not be recovered after the five year storage period, any
replaced/substituted soil material will be of the same volume, quality, and viability of the
material originally removed.
0 Bowie will be held to the reclamation) standards as outline in the Conditions of Approval
for the Hubbard Creek Shaft.
If you have any questions or concerns, please contact Ryan Taylor of my minerals staff at 970-
527-4131.
Sincerely,
/s/ Ryan Z.
