In your correspondence dated Nov. 26, 2007, you also stated that excess top soil (estimated <br />at 500 yd3) is expected to be temporarily stored off site. <br />The USFS is required to dispose of mineral Taterials under 36 CFR 228, Subpart C. Under <br />Section 228.62, the USFS can issue a "Free-use" permit to local governments, providing mineral <br />materials at no charge, with a few prohibitions. In this particular case the USFS has no problem <br />issuing the Town Of Paonia a free-use permitt for the excess mineral materials generated at the <br />shaft site. Once the amount of material provided to the Town is finalized, please contact this <br />office and we will follow up with the appropriate paperwork. If material is removed from the <br />Forest and not sent to the Town, then the USFS must charge Bowie for that disposition. <br />With respect to the off-site temporary storages, the USFS grants permission to allow Bowie to <br />temporarily store the topsoil off-site, for up to 5 years, provided the following: <br />• If the exact material can not be recovered after the five year storage period, any <br />replaced/substituted soil material will be of the same volume, quality, and viability of the <br />material originally removed. <br />0 Bowie will be held to the reclamation) standards as outline in the Conditions of Approval <br />for the Hubbard Creek Shaft. <br />If you have any questions or concerns, please contact Ryan Taylor of my minerals staff at 970- <br />527-4131. <br />Sincerely, <br />/s/ Ryan Z.
