Immediately below the RDA is a
sediment pond and below that is Highway 12, then the Purgatoire River.
Above the RDA is a diversion ditch.
Since I have been visiting the mine I have been convinced that the diversion ditch does not have a positive
drainage gradient at all points, and have raised this concern numerous times. During an inspection in the
summer of 2013 (July, I think), I noticed that the ditch had breached following a storm that was smaller
than a 10 year /24 hour event.
As part of the abatement for NOV 008 we required that NECC:
clear the ditch of fallen rocks and trees;
survey the entire length of the ditch to allow comparison of the constructed ditch with the approved
design.
NECC has completed both abatement actions and sent me the results of their survey. I have not yet
studied the results or compared them with the permit. It would be helpful for me to work with another
specialist from our team who has more experience with ditch design to use the survey results and
determine:
if the ditch is constructed in accordance with the approved design;
if the design is adequate;
if and how we will require NECC to alter the ditch.
Thanks,
Leigh
Leigh Simmons
Environmental Protection Specialist
Colorado Division of Reclamation, Alining and Safety
1313 Sherman Street, Room 215
Denver, CO 80203
303 866 3567 (8121)
Sandra L.
