Jared Dains <br />November 18, 2013 <br />Page 3 <br />supplemental augmentation water from the City of Fountain, the Security Water District, or the <br />Widefield Water & Sanitation District. <br />Actual water use and depletions during the operation will be submitted to the Division <br />Engineer and Water Commissioner on a monthly basis. <br />CONDITIONS OF APPROVAL <br />This substitute water supply plan is hereby approved pursuant to Section 37 -90- 137(11), <br />C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of December 1, 2013 and shall be valid through <br />November 30, 2014, unless otherwise revoked, modified, or superceded by decree. If <br />this plan will not be made absolute by a water court action by the plan's expiration date, <br />a renewal request must be submitted to this office with the statutory fee (currently $257) <br />by October 16, 2014. <br />2. A well permit must be obtained in accordance with § 37 -90- 137(2) and (11), C.R.S. Well <br />permit application (receipt no. 3661689) was submitted on September 10, 2013 and is <br />pending evaluation. The provisions of § 37 -90- 137(2), C.R.S., prohibit the issuance of a <br />permit for a well to be located within 600 feet of any existing well, unless the State Engineer <br />finds that circumstances so warrant after a hearing held in accordance with the procedural <br />rules in 2 CCR 402 -5. This hearing may be waived if you are able to obtain statements <br />from the owners of all wells within 600 feet, verifying that they have no objection to your use <br />of the proposed well. Should a new well permit be denied for reasons of 600 foot spacing, <br />or any other legitimate reason, approval of this substitute water supply plan will be <br />cancelled. <br />3. The total surface area of the groundwater exposed at the Fountain Pit site must not exceed <br />0.2 acre during the approval period of this SWSP resulting in an annual evaporative loss of <br />0.58 acre -feet. <br />4. The annual amount of water used at the operation shall not exceed 3.5 acre -feet for dust <br />control and the total product mined shall not exceed 450,000 tons per year (above the <br />water table). <br />5. Total consumption at the Fountain Pit site must not exceed the aforementioned amounts <br />unless an amendment is made to this plan. <br />6. Water pumped from well permit no. 59834 -F must be measured in accordance with the <br />"Amended Rules Governing the Measurement of Tributary Ground Water Diversions <br />Located in the Arkansas River Basin ". <br />7. Pumping from the storage tank during this plan is limited to 3.5 acre -feet for dust <br />suppression purposes. Pumping from well permit no. 59834 -F must not exceed the <br />amount of replacement water available minus transit losses unless an amendment to this <br />plan provides additional replacement supplies. <br />8. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />
