a significant area of disturbance. Refer to the attached designs for the <br />proposed pond width and length. Aa this pond was sized to accept only <br />drainage from the fill outslopes, a clean water diversion ditch would be <br />required above the pond to divert natural runoff flows around the pond. <br />This would create a significant additional disturbance to the steep <br />hillside. Instabilities of the pond embankment would also exist upon <br />saturation of the pond embankment soils. CWZ has consulted with Dr. James <br />Pendleton of the Colorado Mined Land Reclamation Division and he has <br />concurred that both ponds are unstable, undesirable and unfeasible. <br />To construct concrete dikes or other ponding structures would also be <br />unfeasible. It should also be noted that additional valuable riparian <br />habitat would be destroyed should a pond be constructed in this area. <br />C <br />C~ <br />- 4 - <br />
