Pineda <br />Director <br />Fort Lupton, CO 80621 <br />RE: Bates- Hunter Mine; DRMS File No. M- 1990 -041; Notice of Outstanding Corrective <br />Actions <br />Dear Mr. Otten, <br />The above - mentioned site has had one or more problems noted that, according to Division of <br />Reclamation, Mining and Safety (Division) records have not yet been resolved. According to our <br />records, the following problems were to be resolved on or before October 18, 2013. Listed <br />below are descriptions and corrective actions for the problems. Please resolve the corrective <br />actions and provide evidence of such resolution on or before November 29, 2013. <br />Please note that if the corrective actions are not properly addressed, and evidence provided to the <br />Division by the date provided above, the listed problems could be escalated to the level of <br />possible violations and would then be referred to the Mined Land Reclamation Board for further <br />action. <br />Problem/Corrective Action Description: <br />1. Erosion gullies and ruts were observed on -site. The operator shall provide photo <br />documentation to the Division verifying erosion gullies and ruts have been repaired, and that <br />the site has been reconstructed and stabilized to prevent erosion damage by the corrective <br />action date. <br />2. The Division observed unlabeled 55 gallon drums of chemicals /reagents on the south side of <br />the mill building. The Operator shall provide an updated chemical /reagent inventory of the <br />type, quantity, volume and chemical composition for each milling reagent stored at the <br />Golden Gilpin Mill, including reagents stored within the mill. The Operator shall move all 55 <br />gallon barrels into the mill facility. The barrels shall be properly labeled and shall be stored <br />off the ground. The Operator shall complete the corrective action by the specified date and <br />shall notify the Division when the corrective action has been complied with; the Division will <br />conduct a follow -up inspection to confirm compliance. <br />3. The Division observed a 55 gallon steel barrel on the south side of the mill building. The <br />barrel was corroded and the contents had spilled onto the ground.
