Pineda <br />Director <br />The above - mentioned site has had one or more problems noted that, according to Division of <br />Reclamation, Mining and Safety (Division) records have not yet been resolved. According to our <br />records, the following problems were to be resolved on or before October 31, 2013. Listed <br />below are descriptions and corrective actions for the problems. Please resolve the corrective <br />actions and provide evidence of such resolution on or before November 29, 2013. <br />Please note that if the corrective actions are not properly addressed, and evidence provided to the <br />Division by the date provided above, the listed problems could be escalated to the level of <br />possible violations and would then be referred to the Mined Land Reclamation Board for further <br />action. <br />Problem/Corrective Action Description: <br />1. The affected area boundary markers are missing or incorrectly placed. The operator- shall <br />conduct a survey and replace the boundary, markers in the correct location(s). The operator <br />shall provide proof to the Division that this has been done by the corrective action date. <br />2. Trash and refuse was noticed on the site. To bring the operation into compliance with 34-32 - <br />116(7)(d) C.R.S. submit photographic evidence that the refuse problem at the site has been <br />abated. Equipment that is damaged to the point that it is no longer usable should be <br />removed. Any equipment that is not planned for use in the foreseeable future should also be <br />removed. <br />3. The adit portal presents a safety hazard and must be adequately safeguarded to prevent entry <br />from the public.
