Combined SWSP <br />November 12, 2013 <br />Page 4 of 5 <br />This plan shall be valid for the period of November 12, 2013 through October 31, 2014 unless <br />otherwise revoked or modified. If operation under this SWSP will be required for an additional <br />period, a renewal request must be submitted to this office with the statutory fee (currently $257 <br />for each mining site) no later than August 31, 2014. <br />2. The total area of pond surface exposed after December 31, 1980 shall not exceed 40.56 acres <br />at the Larimer Pit, 2.81 acres at the Mariana Butte Pit, and 17.2 acres at the Baer Pit, as shown <br />in Table A of this approval. Should the total surface area exposed exceed those amounts, an <br />amendment to this plan will need to be filed with this office. <br />3. The total amount of ground water to be appropriated from each of the pits shall not exceed the <br />values listed in Table B of this approval. Total consumption must not exceed these <br />aforementioned amounts unless an amendment is made to this plan. <br />4. Approval of this plan is for the purposes as stated herein. Any additional uses of water must <br />first be approved by this office. Any future additional historical consumptive use credit given <br />(e.g., agricultural water transfer) for this site must consider all previous credits given. <br />5. All releases of replacement water must be sufficient to cover all out -of- priority depletions in <br />time, place, and amount and must be made under the direction and /or the approval of the water <br />commissioner. The release of replacement water may be aggregated to maximize beneficial <br />use. The water commissioner and /or the division engineer shall determine the rate and timing <br />of an aggregated release. <br />6. The use of Applicant's 120 inches of the Barnes Ditch as a replacement source is subject to the <br />Applicant's compliance with the terms and conditions decreed in case no. 2000CW143, <br />including the maintenance of historic return flows. <br />7. The water attributable to the 120 shares of the Barnes Ditch must continue to be diverted in- <br />priority at the ditch then measured back to the Big Thompson River in the vicinity of the subject <br />pits, or at another location upon approval of the water commissioner. Adequate measuring <br />devices acceptable to the water commissioner must be installed. <br />8. All pumping for dust control purposes shall be measured in a manner acceptable to the division <br />engineer. <br />9. The replacement water that is the subject of this plan cannot be sold or leased to any other <br />entity during the term of this approval. As a condition of the subsequent renewals of this <br />substitute water supply plan, the replacement water must be appurtenant to this site until <br />operations under the plan for augmentation in decreed in case no. 2000CW142 recommence. <br />All replacement water must be concurrent with depletions in quantity, timing and location. <br />10. Adequate accounting of diversions, cubic yards of concrete batching, tons of mined product, <br />water used for dust suppression, and replacements must be provided to the division engineer <br />and the water commissioner on a monthly basis or other interval acceptable to both of them. <br />The accounting must be emailed to the water commissioner, Jason. Smith2Qstate.co.us, and <br />Div1Accounting(astate.co.us within 30 days of the end of the month for which the accounting <br />applies. Accounting and reporting procedures are subject to approval and modification by the <br />division engineer. All amounts shall be in acre -feet, except concrete batching, which shall be in <br />cubic yards, and mined product, which shall be in tons. <br />
