(BME) submittal of Minor Revision 157 (MR-157) for the Deserado
Mine. The revision was received on October 30, 2013 and deemed completed on November 6,
2013. MR-157 requests modifications within the permit to address as-built conditions to RDH-
3, SH-1 and two additional areas. Additional discussions concerning weed control measure
updates to address current thoughts on the control of cheatgrass by herbicides and with the use
of forage kochia is also included. The Division has the following comment:

Rule 3.02.2 – Determination of Bond Amount

1.From our earlier discussion, the removal of structures from the Deserado Mine Permit
that were never constructed would subsequently reduce the amount of bond liability.
Due to the reduction in bond liability, the request would have to be submitted as a bond
reduction technical revision. As mentioned from our discussion, all structures removed
with the proposed MR-157 will need to be reapplied to the proposed permit text. If BME
wishes to remove these structures, please submit a separate bond reduction technical
revision or as discussed between the Division and BME, these items can be addressed
with the future Deserado Mine permit renewal. The Division respectfully requests all
mentions of the structures initially proposed to be removed with MR-157 be reapplied
Office of Office of

Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
