Liberty Mining, LLC <br />DRMS 110 -d Permit Application <br />October 2013 <br />EXHIBIT U DESIGNATED MINING OPERATION ENVIRONMENTAL <br />PROTECTION PLAN <br />U (1) Environmental Protection Plan <br />The Liberty Mine is a conventional underground uranium and vanadium mine and is subject to <br />Colorado Division of Reclamation, Mining, and Safety (DRMS) Hard Rock/Metal Mining Rule 1 <br />(14) (d) as a 110 -d Designated Mining Operation (DMO). The mining operation is proposed to <br />be a Limited Impact Operation in accordance of DRMS Hard Rock /Metal Mining Rule 1 (27).The <br />regulation requires each DMO permit application to provide an Environmental Protection Plan <br />(EPP). The Liberty Mine Environmental Protection Plan is designed in accordance with the <br />Colorado Mined Land Reclamation Act and the Mineral Rules and Regulations to protect the <br />welfare of mine employees, the general public and the environment. <br />U (2) Maps — Environmental Protection Plan <br />The Environmental Protection Plan Map is in section E of this permit application. The impacts <br />of the Liberty Mine operations are expected to be minimal given the design and implementation <br />of stormwater controls and the isolation of the mine location with respect to surface waters and <br />groundwater <br />U (3) Identification of other agencies' environmental protection measures <br />Environmental protection measures required by other agencies can be found below in Section U <br />(4). <br />U (4) Other Permits and Licenses <br />U (4.a) Colorado air Pollution Emission Notice for Fugitive Dust <br />To be obtained - An Air Pollution Emission Notice (APEN), issued by the CDPHE Air Pollution <br />Control Division (APCD), will be obtained prior to the commencement of mining operations. The <br />notice will detail procedures and practices to minimize fugitive dust emissions during mining <br />operations. A copy will be forwarded to DRMS within 45 days of receipt from the APCD. <br />U (4.b) Colorado Construction Stormwater Management Plan <br />A Colorado Construction Stormwater Management Plan (SWMP) will be prepared, a Notice of <br />Intent filed with CDPHE, and the SWMP implemented, BMPs installed, and maintained through <br />the life of the operation. <br />U (5) Designated Chemical(s) Evaluation <br />No designated chemicals will be used on site during the life of the Liberty Mine. All metallurgical <br />processing will be off site at a permitted facility. <br />Uranium ore, defined by the Hard Rock /Metal Mining Rule 6.4.21 (14), has the potential to <br />produce toxic material and is to be managed with appropriate measures during mining <br />operations and reclamation procedures.
