According <br />to the ,U.S. Department of Labor, Mine Safety and Health <br />Administration, the federal government investigates <br />accidents that occur at mine sites that are currently active <br />and in operation. It is the state government who has jurisdiction <br />over investigations at an inactive mine site. Therefore, <br />Wayne's accident is considered a State matter. <br />Colorado State law requires an owner of an inactive <br />mine toifence and post his property. The State Division <br />of Mine's is responsible for enforcing compliance with <br />these regulations. <br />Upon your suggestion, I have contacted ,Mrs._ J,oe,,,�NugS.P—t <br />with the Colorado State Division of Mines. As you know,; <br />he is supervising the State's handling of your son's <br />accident. Mr. Nugent concludes that the State has responded <br />responsibly to this situation, although he is extremely <br />= <br />dismayed over'_the tragedy. <br />As you know, for the past year, a project has been <br />pending in the state of Colorado to close off approximately <br />50 of the most hazardous inactive mine sites with a <br />$2 million federal grant in accordance with the Mine <br />Land Reclamation Act. The project will begin in July. <br />It is unfortunate that an. accident like Wayne's had to <br />take place before the red tape barring the project'-s beginning <br />could b'e cut through. The State is also developing an <br />;Y <br />improved mine hazard awareness program. <br />p <br />cF <br />Mr. Nugent has assured me that once you have given <br />permission to fill, and eventually ca the mine, your wishes <br />to p ace.a memorial at the sight will undoubtedly be ,heeded_. <br />e is st311 in the process of determining who the actual <br />owners of the mine are.
