According
to the ,U.S. Department of Labor, Mine Safety and Health
Administration, the federal government investigates
accidents that occur at mine sites that are currently active
and in operation. It is the state government who has jurisdiction
over investigations at an inactive mine site. Therefore,
Wayne's accident is considered a State matter.
Colorado State law requires an owner of an inactive
mine toifence and post his property. The State Division
of Mine's is responsible for enforcing compliance with
these regulations.
Upon your suggestion, I have contacted ,Mrs._ J,oe,,,NugS.P—t
with the Colorado State Division of Mines. As you know,;
he is supervising the State's handling of your son's
accident. Mr. Nugent concludes that the State has responded
responsibly to this situation, although he is extremely
=
dismayed over'_the tragedy.
As you know, for the past year, a project has been
pending in the state of Colorado to close off approximately
50 of the most hazardous inactive mine sites with a
$2 million federal grant in accordance with the Mine
Land Reclamation Act. The project will begin in July.
It is unfortunate that an. accident like Wayne's had to
take place before the red tape barring the project'-s beginning
could b'e cut through. The State is also developing an
;Y
improved mine hazard awareness program.
p
cF
Mr. Nugent has assured me that once you have given
permission to fill, and eventually ca the mine, your wishes
to p ace.a memorial at the sight will undoubtedly be ,heeded_.
e is st311 in the process of determining who the actual
owners of the mine are.
