Jim asked me to <br />contact Ms. Kunz, and 1 spoke with her by phone this morning. <br />After Mr. Tease's accident, the Colorado Inactive Mine Reclamation Program (CIMRP) <br />safeguarded the Mary McKinney Mine shaft as feature 42 in the Cripple Creek project <br />(subaccount number 08083) under grant number G5157082. I understand from your June <br />16, 2010, e-mail message that the Mary McKinney Mine is located on land that CC &V owns <br />as the successor in ownership to Texas Gulf. I further understand that CC &V is conducting <br />mining operations on its land under an approved active mining permit that the Division of <br />Reclamation Mining, and Safety (DRMS), Minerals Program, administers. Also, I <br />understand that CIMRP wasn't a party to any agreement between Texas Gulf, the <br />landowner at the time of Mr. Tease's accident, and Ms. Kunz. <br />At this point, it appears more information about CC &V's activities would help. Ms. Kunz <br />already contacted Ms. Jane Mannon, CC &V Community Affairs Manager, for information <br />but needs more. Ms. Kunz believes the Mary McKinney Mine shaft should not be disturbed <br />because it's her son's grave. Further, she has reason to believe CC &V's activities are <br />encroaching on the Mary McKinney Mine shaft but she isn't sure whether or not those <br />activities will disturb her son's interment. The Office of Surface Mining, Reclamation and <br />Enforcement (OSM), Denver Field Division's Cripple Creek project file doesn't contain <br />information that describes restrictions, if any, on activities that may lawfully be conducted <br />near or at the safeguarded Mary McKinney Mine.
