PERMIT #: M- 2006 -042 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: October 24, 2013 <br />highwalls with a stripped area above the southern highwall. A fronted loader was observed at the site. The <br />Operator stated the plan is to mine through the southeast hillside. <br />The approved mine plan for the site states mining will progress from the southeast to the northwest. The <br />Division recommends the Operator submits a technical revision to clarify the mining plan, since the direction <br />of mining has change to northwest to southeast. <br />The permit boundary corner markers and the estimated affected area were GPS surveyed with a Trimble Juno <br />3B by the Division. A map showing the results of the GPS survey is attached. The survey indicated a permit <br />boundary of 10.26 acres, 0.36 acres greater than the approved 9.99 permit boundary. The survey did not <br />include the access road in the 10.26 acres, since the markers for the access road were not located during the <br />inspection. The Division estimates 1.8 acres of mining disturbance have occurred outside the permitted <br />boundary based on the survey. The estimate does not account for the access road acreage and any error in the <br />marked permit boundary corners. As cited as a problem on the first page, the Operator shall conduct a survey <br />and replace the boundary markers in the correct location(s). The Operator shall provide proof to the Division <br />that this has been done by the corrective action date and contact the Division to schedule a follow -up <br />inspection. <br />The approved post- mining land use for the site is pastureland. The approved reclamation plan requires the <br />Operator to regrade the slopes to 3H:1V and replace 2 -3 inches of topsoil on the affected land. Reclamation <br />activities on the northwestern portion of the site are complete and vegetation appeared to be establishing. <br />No noxious weeds were observed during the inspection. <br />The Division holds a financial warranty in the amount of $28,333.00, which appears adequate based on this <br />inspection. <br />Photographs taken during the inspection are attached. <br />Page 2 of 4 <br />
