cessation of mining in any area, consistent with the need for verification of the <br />subsidence prediction. <br />For the Elk Creek Mine, the applicant conducted an inventory of "all structures and <br />renewable resource lands which exist within the proposed permit and adjacent <br />area" as required by Rule 2.05.6(6)(a). The determination was that no such <br />structures or features exist within the area to be undermined by the Elk Creek <br />activity. Therefore, no further action was required. The operator, though, <br />submitted a subsidence evaluation for the area, which can be found in Volume 12 <br />of the permit, Exhibit 2.05 -E8. <br />In response to a stipulation on the federal coal lease, the operator will conduct a <br />detailed survey in two parts — the spring and fall of 2003 - for previously <br />unidentified water resources. If any such resources are identified and could be <br />impacted by subsidence, the operator will submit a plan for replacement to the US <br />Bureau of Land Management and /or the US Forest Service. <br />XII. Operations on Alluvial Valley Floors <br />A. The Division has determined that an alluvial valley floor exists in an adjacent area. <br />Therefore, the following findings are in order for the alluvial valley floor that is <br />located on the North Fork of the Gunnison River downstream from the mine site. <br />1. The Division finds that activities proposed by the applicant will not interrupt, <br />discontinue, or preclude farming on the alluvial valley floors that are irrigated <br />or naturally sub - irrigated (4.24.3(1)). <br />2. The proposed activities will not materially damage the quantity or quality of <br />water in the surface or ground water system described above (4.24.3(3) and <br />2.06.8(5)(a)(ii)). <br />3. Coal mining and reclamation operations will be conducted to preserve the <br />essential hydrologic functions of alluvial valley floors outside the permit area <br />throughout the mining and reclamation process (4.24.2). <br />27 <br />
