The county roads were to be <br />backfrlled to the elevations and locations shown on Map 2.05.3(3) -16 of the permit. Placement and <br />compaction of materials was to be accomplished as illustrated on Map 2.05.3(3) -13. <br />Drainage from the county roads is controlled by a system of roadside ditches and culverts. These <br />features are shown on permit Maps 2.05.3(3) -1 and 2.05 3(3) -1 -2. Ditches C -2, C -11, C -12, C -23 <br />and C -24 and culverts C -117 and C -129 are permanent and were designed for the 100 -year 24 -hour <br />storm event. <br />The county has jurisdiction over the roads and the 30 feet of right -of -way that extends to either side. <br />The post- mining land use is Road, and there were no requirements for topsoil replacement or <br />revegetation within the right -of -way. <br />III. OBSERVATIONS AND FINDINGS <br />PHASE I <br />Backfrlling operations progressed westward of 2700 Road beginning in late 2004. By the summer <br />of 2008, backfrlling of the SL -13 Phase I area was complete, and topsoil had been redistributed <br />across most of the area. The highwall along the northern side of the area was backfilled, as <br />required. The post- mining topography reflects the approved reclamation plan. As discussed under <br />Section II, above, much of the Phase I area is elevated compared with the premining topography. <br />Incorporating the swell factor into this area facilitated reclaiming the property south of BB Road to <br />pre- mining elevations. In addition, the break in slope which parallels Tuttle Draw was shifted <br />approximately 500 feet north of its pre- mining position. This modification was approved under TR- <br />50 in 2003 at the request of the landowner (Benson), who wanted to maximize the amount of land <br />that could be irrigated. <br />During the April 14, 2012 bond release inspection, the slope of the reclaimed area was measured in <br />numerous places using a hand -held inclinometer. A significant portion of the Phase I area consists <br />of a smooth, elevated surface which slopes gently (at 1% to 4 %) to the west and southwest. The <br />surface is bounded by steeper slopes on the north, east and south. These slopes were found to range <br />between 4H:1 V and 5H:1 V to the northeast and east. To the northwest, the upper slope is 8H:1 V, <br />flattening to 20H: IV as it approaches Pond 012 (Figure 1). <br />7 <br />
