Compliance With Mine Plan N - Support Facilities Not On-site <br /> NA -Other N - Special Categories Of Mining <br /> NA -Processing Waste N -Topsoil <br /> COMMENTS <br /> This was a partial inspection of the New Horizon Mine conducted on October 29,2013 by Mike Boulay of the <br /> Division of Reclamation,Mining and Safety Grand Junction Field Office. Ross Gubka and David Anderson of <br /> Western Fuels-Colorado and Chris Gilbreath of Tri-State Generation and Transmission Association,Inc. (Tri- <br /> State)were present during the entire inspection. Weather conditions were cold and raining with intermittent sleet. <br /> Ground conditions were wet and muddy and became increasingly worse as the inspection progressed. The <br /> duration of the inspection was cut short due to the inclement weather and difficult driving conditions on non-paved <br /> areas of the site. <br /> HYDROLOGIC BALANCE -Rule 4.05 <br /> Drainage Control 4.05.1,4.05.2,4.05.3; Siltation Structures 4.05.5,4.05.6; Discharge Structures 4.05.7,4.05.10; <br /> Diversions 4.05.4;Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br /> Drainage —Acid and Toxic Materials 4.05.8; Impoundments 4.05.6,4.05.9; Stream Buffer Zones 4.05.18: <br /> Sedimentation Ponds 007,011,and 013 were viewed during this inspection. All of the ponds were retaining water <br /> at the time of the inspection. Pond inlets,embankments and discharge structures were stable at all pond locations. <br /> During the last complete inspection of the site several ditches and culverts were identified as needing maintenance. <br /> Of particular concern was a cutoff ditch that had been in place across the top of the reclaimed slope on Benson- <br /> West and WFC(Lloyd)parcels. A rock-lined ditch that carries flow from the cutoff ditch failed due to a <br /> significant storm event prior to the inspection conducted on September 16,2013. The operator was requested to <br /> review this location and if appropriate revise the permit to incorporate ditch designs for the cutoff ditch and lower <br /> rock-lined ditch,which apparently had not been previously incorporated into the permit. The lower portion of the <br /> rock-lined and cutoff ditches were inspected and are shown in Photographs No. 1 and 2 attached at the end of this <br /> inspection report. Other culvert and ditch locations inspected include Ditch C9 and associated culvert(which <br /> clogged during the storm event)that flows to Pond 013 and a temporary collection ditch recently installed at Pond <br /> 011 to collect and convey runoff to the pond's inlet in the southwest corner,which breached in several spots <br /> during the storm prior to September l6th. Repairs have been made at Ditch C9 and at the temporary conveyance <br /> ditch at Pond 011. Temporary repairs have been made at the cutoff ditch.
