Bowie Resources, LLC Colorado Department of Public Health and Environment <br />Permit No. 06DL1082F Air Pollution Control Division <br />Initial Approval — Modification 1 <br />operated in a manner consistent with good air pollution control practices for <br />minimizing emissions. Determination of whether or not acceptable operating and <br />maintenance procedures are being used will be based on information available to <br />the Division, which may include, but is not limited to, monitoring results, opacity <br />observations, review of operating and maintenance procedures, and inspection <br />of the source. (Reference: Regulation 6, Part A. General Provisions from <br />40CFR60.11) <br />C. No article, machine, equipment or process shall be used to conceal an emission <br />which would otherwise constitute a violation of an applicable standard. Such <br />concealment includes, but is not limited to, the use of gaseous diluents to <br />achieve compliance with an opacity standard or with a standard which is based <br />on the concentration of a pollutant in the gases discharged to the atmosphere. <br />(§ 60.12) <br />d. Written notification of construction and initial startup dates shall be submitted to <br />the Division as required under § 60.7. <br />e. Records of startups, shutdowns, and malfunctions shall be maintained, as <br />required under § 60.7. <br />f. Performance tests shall be conducted as required under § 60.8 <br />10. The process equipment are subject to the process weight rate of Regulation Number 6, Part B, III. <br />C. as follows: <br />For those pieces of equipment with process weight rate of 30 tons per hour or less, pounds per <br />hour emissions of total particulates shall not exceed 3.59 *P °_62, where P = hourly process weight <br />rate (tons per hour). <br />For those pieces of equipment with process weight rate of more than 30 tons per hour, pounds <br />per hour emissions of total particulates shall not exceed 17.31 *P "', where P = hourly process <br />weight rate (tons per hour). <br />OPERATING & MAINTENANCE REQUIREMENTS <br />11. The applicant shall follow the most current operating and maintenance plan and record keeping <br />format approved by the Division in order to demonstrate compliance on an ongoing basis with the <br />requirements of this permit. (Reference: Regulation No. 3, Part B, Section III.G.7.) <br />COMPLIANCE TESTING AND SAMPLING <br />Initial Testing Requirements <br />12. Within 180 days of startup, the owner or operator shall demonstrate compliance with Condition 8, <br />using EPA Method 9 to measure opacity from the conveyor transfer point. <br />NSPS Subpart Y: <br />This measurement shall consist of consecutive readings taken at fifteen second intervals over a <br />one hour period (ten 6- minute averages). If, during the initial 30 minutes of the Method 9 <br />observation, all of the 6- minute average opacity readings are less than or equal to half the <br />applicable opacity limit, then the observation period may be reduced from 1 hour to 30 minutes <br />029100491018 Page 4 <br />
