The Colorado Division of Reclamation, Mining and Safety (Division) has reviewed the
response of New Elk Coal Company (NECC) to the Division's letter of July 16, 2013. Please respond to
the following adequacy comments as necessary:
1. Ownership and control information for NECC and Cline Mining (pages 2.03 -3, 4 and 4a)
should be reviewed and updated to reflect recent changes.
2. Surface and mineral ownership. This issue has been resolved.

4. Permit term dates. This issue has been resolved.
5. Coal lease agreement. This issue has been resolved.
6. Soils map. This issue has been resolved.
Jeff Canyon haul road. This issue has been resolved.
8. Threatened and endangered species survey. This issue has been resolved.
Is there one map that shows all the approved culverts? Along the access road and the sediment
pond access roads, there are approved culverts that are NECC's responsibility and have been
designed for specific flows. On the ground additional culverts have been installed by a third
party (oil and gas development) and are not NECC's responsibility for maintenance. A map
with all of the culverts on it, which defines which culverts are NECC's responsibility and which
are not, has not been identified. This map would need to be specific to the actual area of
disturbance for the Jeff Canyon Surface Mine. If one does not already exist in the permit,
NECC needs to provide a single map that provides this information.
