Pineda <br />Director <br />The Colorado Division of Reclamation, Mining and Safety (Division) has reviewed the <br />response of New Elk Coal Company (NECC) to the Division's letter of July 16, 2013. Please respond to <br />the following adequacy comments as necessary: <br />1. Ownership and control information for NECC and Cline Mining (pages 2.03 -3, 4 and 4a) <br />should be reviewed and updated to reflect recent changes. <br />2. Surface and mineral ownership. This issue has been resolved. <br />NOV information. This issue has been resolved. <br />4. Permit term dates. This issue has been resolved. <br />5. Coal lease agreement. This issue has been resolved. <br />6. Soils map. This issue has been resolved. <br />Jeff Canyon haul road. This issue has been resolved. <br />8. Threatened and endangered species survey. This issue has been resolved. <br />Is there one map that shows all the approved culverts? Along the access road and the sediment <br />pond access roads, there are approved culverts that are NECC's responsibility and have been <br />designed for specific flows. On the ground additional culverts have been installed by a third <br />party (oil and gas development) and are not NECC's responsibility for maintenance. A map <br />with all of the culverts on it, which defines which culverts are NECC's responsibility and which <br />are not, has not been identified. This map would need to be specific to the actual area of <br />disturbance for the Jeff Canyon Surface Mine.
