WFC Property in southeast part of permit area. Originally Irrigated Pasture, the <br />parcel will be reclaimed to Dryland Pasture because no water is available. The <br />land will be graded such that irrigation could occur in the future. <br />Morgan Property — All 107.96 disturbed acres of the Morgan property have been <br />designated Prime Farmland. WFC is proposing to return the entire Morgan parcel <br />to cropland — irrigated alfalfa hay. <br />WFC consulted with each landowner during the review process for PR -6 as required <br />by Rule 2.05.5(1)(b). Documentation of the consultation is provided in Attachments <br />2.05.4(2)(e) -6, 8, 9 and 10 of permit Section 2.05.4(2)(e). Additional consultations <br />and attempts to resolve disputes with the Morgan's is addressed in WFC's letter dated <br />August 13, 2010 and in Addendum 92 to WFC's letter dated September 20, 2010. <br />The Division is proposing to approve the post- mining land uses of irrigated <br />pastureland, cropland - irrigated alfalfa hay, dryland pasture, irrigated pasture swales, <br />commercial areas and ponds in the NH Mine 2 permit block. (4.16.1 and 4.16.3) <br />XIII. Protection of Fish, Wildlife and Related Environmental Values <br />Fish and wildlife habitat is a planned post- mining land use. The applicant has selected <br />appropriate plant species and distributions to benefit fish and wildlife (4.18(5)(i)). <br />XIV.Protection of Undermund Mining <br />This section does not apply to the New Horizon Mine. <br />XV. Subsidence Control <br />The New Horizon Mine is a surface mine; subsidence is not a consideration. <br />XVLConcurrent Surface and Underground Mining <br />There are no concurrent surface and underground mining operations at the New Horizon <br />Mine. <br />XVIL Operations on Alluvial Valley Floors <br />The Division has determined that there are no alluvial valley floors along Tuttle or <br />Calamity Draws by definition. Geomorphically, these draws are located in uplands several <br />miles northeast of the San Miguel River. The uplands are overlain by less than ten feet of <br />unconsolidated material, which has been classified as aeolian and sheet wash material. <br />(The depths of unconsolidated material are documented in Appendix 6 -1.)
