10/29/13 State.co.us Eecutive Branch Mail - Fwd: Terror Creek Loadout (C- 1983 -059) Maps and RN -06
Oxbow (Dining, LLC., Elk Creek Mine
Somerset, Co. 81434
970- 929 -5806, fax: 970- 929 -5177
From: Stark - DNR, Jim [mailto:jim, stark @state.co.us]
Sent: Monday, September 09, 2013 10:49 AM
To: Jim Kger
Cc: Alysha Hernandez - DNR; Mary Rodriguez - DNR
Subject: Terror Creek Loadout (C- 1983 -059) Maps and RN -06
Jim,
There has been considerable internal discussion regarding the requirement of coal ownership maps for permitted
sites. The first topic was whether or not any unleased coal within a mine's permit boundary should be included or
shown on the coal ownership map. The direction we received is that yes, all coal within a permit boundary,
whether leased or not, needs to be included and shown on the coal ownership map. The second issue was
whether or not coal ownership at loadout only sites (of which there are three in Colorado) must be shown on a
map and included in the permit (even though no coal is permitted to be mined). Again, the direction we received
was that yes, ern coal loadouts (only) need a coal ownership map. Since there is no actual mining at these
sites, all coal will, in all likelihood, be unleased coal and needs to be shown as such on the coal ownership map.
That leads me to the Terror Creek Loadout and you. There is no coal ownership map in the Terror Creek Loadout
permit. Since we are currently in a permit renewal, this is a perfect time to get this map into the permit. Please
prepare a coal ownership map for the Terror Creek Loadout and send it to the Division for review and
inclusion into the RN -06 application and, ultimately, the permit. And, just a heads -up, if the coal
ownership map shows that there is any federally owned coal under the Terror Creek Loadout, this will probably
change the loadout's status from a "private" mine to a "federal" mine.
Thank you and please let me know if you have any questions.
James R Stark
Colorado Department of Natural Resources
Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, CO 80203
https: / /mail.g oog le.conVmai I /u /0 / ?ui =2 &i k= e29129fcb5 &view= pt &search =i nboy&th= 1420587b3Oe5l l d0 2/3
