10/29/13 State.coms Decutive Branch Mail - Fwd: Terror Creek Loadout (C-1983-059) Maps and RN-06
Stark - DNR, Jim <jim.stark@state.co.us> Tue, Oct 29, 2013 at 12:43 PM
To: Daniel Hernandez - DNR <daniel.hernandez@state.co.us>
Cc: Mary Rodriguez - DNR <mary.rodriguez@state.co.us>, Alysha Hernandez - DNR
< alys ha. hernandez @state. co. us>
Dan,
Here is the e-mail from Kiger. I was incorrect when I said that there was something in the permit stating there
was no coal. It was in the findings that stated the loadout was on the Mancos Shale, which has no coal. I have
attached Map 2 - Regional Geology, for your information. Please let me know if you need any additional
information.
---------- Forwarded message ---- - - - - --
From: Jim Kiger <Jim. There are no coal seams found in the Mancos
Shale. The coal seams in the region are located in the Mesa Verde Formation located further north, east
and south.
Further, page 5 of the Division's May 23, 2008 - Progosed Decision and Findin s of Compliance Lora Permit
Renewal also acknowledges the location of the TCLLC facility on Mancos Shale.
As such, Oxbow/TCLLC believes that a special map, showing the absence of ownership of a non-existent
coal resource, would seem superfluous and unreasonable.
!Wllllllil
Environmental Manager
hftps:llmail.gc)ogle.conVmaillul0l?ui=2&ik--e29129fcb5&view--pt&search=inboy&th=1420587b3Oe5lldO 1/3
